When noise from a neighbouring property is causing a nuisance,
initially the best way to deal with the problem is to go to the
source and try to resolve it amicably. Often your neighbour will
not be aware that they are even causing a problem.
The Council has powers under the
Environmental Protection Act 1990 (sec79) (external
link) to deal with statutory nuisance. In most cases the
Council will try to resolve your complaint informally. However if
this fails and the Council has assessed the noise as being a
statutory nuisance then an abatement notice will be served on the
person responsible.
This notice can stipulate certain actions required to stop the
nuisance or simply require the nuisance to stop. Failure to comply
with an abatement notice is an offence. In a very few cases failure
to comply with a notice may result in prosecution or seizure of
noise equipment.
